We at <strong>Marina Porto Antico, the tourist port of Genoa<\/strong>, know this very well. Every year, we see many diverse boaters mooring in our <a href=\"https:\/\/marinaportoantico.it\/en\/berth-genoa\/\">berths<\/a>: from those arriving with a <strong>Genoese gozzo<\/strong> to those going out fishing on inflatable boats, from sports sailors dedicated to regattas to owners of the most elegant and large yachts. These are different ways of experiencing and approaching the sea, but all united by a deep <strong>passion<\/strong> for <a href=\"https:\/\/www.tuttobarche.it\/magazine\/\" target=\"_blank\" rel=\"noopener\">recreational boating<\/a> and marine nature. But as we know, it can&#8217;t all be fun. Once you leave the <strong>mooring<\/strong>, after exiting the marina, you can breathe in the freedom of the navigator, without forgetting, however, that there are <strong>rules<\/strong> to be respected. The routes to maintain, speeds not to exceed, safety equipment to always keep on board, and so on. This is because sometimes a small distraction, even a minor <strong>transgression<\/strong> of the rules in force, can lead to far from negligible <strong>risks<\/strong>. And for this very reason, the legislator, aiming for an increasingly <strong>safer<\/strong> recreational boating, has decided to introduce the crime of <strong>nautical homicide<\/strong> into the Italian legal system: let&#8217;s see how this decision was reached and what penalties are provided.       <img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter wp-image-23130 size-full\" title=\"new law\" src=\"https:\/\/marinaportoantico.it\/wp-content\/uploads\/2023\/10\/nuova-legge.jpg\" alt=\"new law\" width=\"1600\" height=\"900\" srcset=\"https:\/\/marinaportoantico.it\/wp-content\/uploads\/2023\/10\/nuova-legge.jpg 1600w, https:\/\/marinaportoantico.it\/wp-content\/uploads\/2023\/10\/nuova-legge-300x169.jpg 300w, https:\/\/marinaportoantico.it\/wp-content\/uploads\/2023\/10\/nuova-legge-1024x576.jpg 1024w, https:\/\/marinaportoantico.it\/wp-content\/uploads\/2023\/10\/nuova-legge-768x432.jpg 768w, https:\/\/marinaportoantico.it\/wp-content\/uploads\/2023\/10\/nuova-legge-1536x864.jpg 1536w\" sizes=\"(max-width: 1600px) 100vw, 1600px\" \/><\/p><p><strong>Nautical homicide: a tough law as a deterrent<\/strong><\/p><p>The introduction of the crime of nautical homicide certainly didn&#8217;t come unexpectedly. In fact, it was a law that was already ready to be approved by the Chamber in the last legislature, but had been blocked by the government crisis. On <strong>September 18, 2023<\/strong>, nautical homicide became law, with a rather short legislative process. Until that moment, those who caused the death of a person by negligence while operating a vessel faced the &#8220;reduced&#8221; penalties of simple homicide. This was indeed far from consistent with the Italian legal system, knowing that on land, and more precisely on the road, the crime of <strong>vehicular homicide<\/strong> has existed since 2016. On asphalt as in water, the introduction of a tough law against homicide caused by negligence by drivers who do not respect the rules serves as a deterrent, with the awareness that more can be done to prevent <strong>accidents at sea<\/strong>. What accelerated the legislative process was the sadly notorious fatal accident on Lake Garda in which a motorboat driven by two Germans &#8211; under the influence of alcohol &#8211; took the lives of Greta Nedrotti and Umberto Garzarella, in June 2021; a few days later, the same happened on Lake Como, when a boat piloted by Belgian tourists crashed into another boat, causing the death of Luca Fusi.     <\/p><h4>The Penalties Provided<\/h4><p><strong>Article 589 bis of the Penal Code<\/strong> has been modified in an attempt to make navigable waters safer, adding nautical homicide alongside vehicular homicide. Now, the operator of a vessel who, violating navigation regulations, causes the death of a person, can be punished with <g id=\"gid_1\">imprisonment from 2 to 7 years<\/g>. The new law on nautical homicide also provides for <g id=\"gid_2\">more severe penalties<\/g>, which increase with the severity of the transgression. If the vessel operator is found to be in a state of <g id=\"gid_3\">alcohol intoxication<\/g> or <g id=\"gid_4\">psycho-physical alteration<\/g> due to the use of narcotic or psychotropic substances, the prescribed imprisonment is between 8 and 12 years (for a blood alcohol level of 1.5 grams per liter; if between 0.8 and 1.5 grams, the penalty is between 5 and 10 years). If nautical homicide is committed while performing <strong>professional navigation activities<\/strong>, the penalty is automatically set between 8 and 12 years, while it can go up to <strong>18 years<\/strong> in case of multiple homicides. The penalties can also be increased if the operator does not have a valid <strong>boating license<\/strong>, or if the operator flees after the accident, thus failing to provide due assistance.    <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>The world of navigation is unique, special, and difficult to describe in words.
